Withdrawal and refund policy

1. Scope

This policy distinguishes statutory withdrawal, subscription cancellation, the statutory conformity guarantee and a discretionary commercial gesture. It forms part of the Terms. Mandatory consumer rights always prevail.

2. Statutory withdrawal period

A consumer entering a distance contract normally has 14 days from contract formation to withdraw without giving a reason. Where the last day is a Saturday, Sunday or public holiday, the period is extended as the applicable law provides.

Before expiry, send any unambiguous statement:

• by email to legal@equarith.com with subject “Withdrawal”; or
• by post to Brandonn Etheve — Equarith, 8 Ruelle Boulot, 97400 Saint-Denis, Réunion, France.

Include the name, order email, order reference if available, offer and date. No reason is required. Equarith acknowledges the request on a durable medium.

3. Immediate supply and loss of withdrawal

Equarith is digital content supplied without a tangible medium. To receive the download and key before the 14 days end, the consumer must select a separate box that:

1. expressly requests immediate supply; and
2. acknowledges loss of the withdrawal right once digital-content performance has begun.

Providing download access and issuing an active key begins performance. Confirmation of the request and acknowledgement is sent by email. If all requirements are not met, the right continues until its statutory expiry.

Loss of withdrawal never removes the conformity guarantee, a refund right for Equarith-caused non-supply or another mandatory remedy.

4. Effect of valid withdrawal

For a valid withdrawal, Equarith refunds affected payments within 14 days after learning of the decision, using the same payment method unless the consumer expressly agrees to a no-fee alternative. The licence is deactivated and the consumer must stop using and delete the affected copies to the extent permitted by law.

Equarith may request information strictly necessary to locate the transaction. Never send a full card number or security code.

5. Subscriptions

Withdrawal unwinds a contract under the rules above. Cancellation stops future renewals and may be requested at any time through the billing portal in the account. Unless law or the offer says otherwise, it takes effect at the end of the paid period and does not generate a prorated refund.

An erroneous renewal, a charge after effective cancellation or missing mandatory renewal notice is reviewed under applicable law and may be refunded.

6. Defects, duplicate payments and non-supply

A software defect is handled under the statutory guarantee in the Terms. Equarith may first offer conformity where that is the proper legal remedy. A confirmed duplicate charge, amount differing from the final summary or order that cannot be supplied is refunded without undue delay.

Outside statutory rights and an express offer at checkout, Equarith does not promise a “money-back guarantee”. An exceptional request may still be considered case by case without creating a right for other orders.

7. Business customers

A customer acting solely for business normally has no consumer withdrawal right. Any mandatory extension to an eligible small business remains available when all statutory conditions are met. Billing errors, agreed warranties and statutory liabilities are separate from withdrawal.

9. Contact and disputes

Requests are handled at legal@equarith.com. If a disagreement remains after a prior written complaint, a consumer may refer the matter to CM2C free of charge using the details in the Terms.
